Terms of Use

1. Acceptance of Terms

Welcome to Together Hub. These Terms of Use ("Terms") govern your access to and use of the Together Hub mobile application (the "App"), the website located at togetherhub.tech, and all related services (collectively, the "Service"), operated by Together Hub ("we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Service. We recommend that you save or print a copy of these Terms for your records.

2. Description of Service

Together Hub is a collaborative organization platform designed for couples, families, roommates, and friend groups. The Service allows users to create and manage shared calendars, grocery lists, to-do lists, meal plans, trip itineraries, notes, and other collaborative content within private groups. The Service may also include AI-powered features, calendar synchronization with third-party services, and push notifications.

3. Account Registration

3.1 Accurate Information

To use the Service, you must create an account by providing accurate, current, and complete information. You agree to update your account information promptly if it changes. Providing false or misleading information may result in the suspension or termination of your account.

3.2 Credential Responsibility

You are responsible for maintaining the confidentiality of your account credentials, including your password and any authentication tokens (such as Apple Sign-In). You are fully responsible for all activities that occur under your account. You agree to notify us immediately at support@togetherhub.tech if you suspect any unauthorized use of your account or any other breach of security.

3.3 Age Requirement

You must be at least 13 years of age to create an account and use the Service. If you are under 18 years of age, you represent that you have your parent's or legal guardian's permission to use the Service. By creating an account, you represent and warrant that you meet these age requirements.

3.4 Right to Suspend

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to a violation of these Terms, fraudulent activity, or conduct that we determine to be harmful to other users, us, or third parties.

4. User Content

4.1 Definition

"User Content" refers to any content that you create, upload, submit, or share through the Service, including but not limited to lists, events, meals, meal plans, trip itineraries, notes, comments, images, profile information, and any other materials you contribute to the Service.

4.2 Ownership and License

You retain full ownership of your User Content. By submitting User Content to the Service, you grant Together Hub a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and process your User Content solely for the purpose of operating, providing, improving, and promoting the Service. This license ends when you delete your User Content or your account, except to the extent that your content has been shared with others who have not deleted it, or as otherwise required by law.

4.3 Responsibility and Prohibited Content

You are solely responsible for your User Content and the consequences of posting or sharing it. You represent and warrant that your User Content does not violate any applicable law, regulation, or these Terms. You agree not to create, upload, or share User Content that:

4.4 Right to Remove

We reserve the right, but have no obligation, to review, monitor, or remove User Content at our sole discretion, at any time and for any reason, including but not limited to content that we believe violates these Terms or may be harmful to other users or third parties. We are not responsible for any failure to remove or any delay in removing User Content.

5. Shared Groups

5.1 Visibility

When you create content within a shared group, that content is visible to all members of that group. You acknowledge and agree that any content you add to a shared group can be viewed, edited, or deleted by other members of that group depending on their permissions. Please exercise care when sharing content in groups.

5.2 Admin Controls

Group administrators have the ability to manage group membership, including inviting and removing members, and may have additional controls over group settings and content. The group creator is the initial administrator, and admin privileges may be transferred or shared at their discretion.

5.3 Content Persists After Leaving

If you leave or are removed from a group, content you contributed to that group may persist and remain visible to other group members. You may request deletion of specific content prior to leaving a group by deleting it yourself, or by contacting us for assistance.

5.4 No Responsibility for Other Members

Together Hub is not responsible for the actions, content, or conduct of other group members. You use shared groups at your own discretion and risk. We encourage you to only join groups with people you know and trust.

6. Subscriptions and Payments

6.1 Subscription Tiers

Together Hub offers multiple subscription tiers, including a free tier with limited features, a Pro tier for individual users with enhanced features, and a Family tier for households. The specific features, limitations, and pricing of each tier are described within the App and on our website, and may change from time to time.

6.2 Pricing

Subscription prices are displayed within the App at the time of purchase. We reserve the right to change subscription pricing at any time. Any price changes will take effect at the start of your next billing cycle following the date of the price change. Your continued use of the Service after a price change constitutes your acceptance of the new pricing.

6.3 Free Trials

We may offer free trial periods for paid subscription tiers. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends. You will be charged the applicable subscription fee through your Apple App Store account.

6.4 Auto-Renewal

All paid subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your selected plan) unless you cancel your subscription at least 24 hours before the end of the current billing period. You can manage and cancel your subscription at any time through your Apple App Store account settings.

6.5 Apple Refunds

All subscription payments are processed through Apple's App Store. Refund requests must be directed to Apple in accordance with Apple's refund policies. Together Hub does not process payments directly and cannot issue refunds. For refund assistance, please visit Apple's support page.

6.6 Downgrade on Cancellation

If you cancel your paid subscription, you will continue to have access to paid features until the end of your current billing period. After that, your account will be automatically downgraded to the free tier. Some content or features that exceed the limits of the free tier may become read-only or inaccessible until you resubscribe.

7. AI Features

7.1 Availability

AI-powered features are available to users on eligible subscription tiers. These features may include meal suggestions, grocery list generation, trip planning assistance, and other AI-driven recommendations. The availability and scope of AI features may change at any time without prior notice.

7.2 Powered by Anthropic

Our AI features are powered by Anthropic's Claude API. When you use AI features, relevant contextual information (such as the contents of a meal plan or list) is sent to Anthropic for processing. We do not send your personal identity, email address, or account information to Anthropic. Anthropic's use of this data is governed by Anthropic's own terms and privacy policy.

7.3 No Guarantee of Accuracy or Safety

AI-generated content is provided for informational and convenience purposes only. We do not guarantee the accuracy, completeness, reliability, or safety of any AI-generated content. AI suggestions should not be relied upon as professional advice, including but not limited to nutritional, medical, dietary, or travel safety advice. You are solely responsible for evaluating and using AI-generated content at your own risk.

7.4 Usage Limits

AI features are subject to usage limits. Currently, each user is limited to 50 AI requests per day. We reserve the right to adjust these limits at any time. If you exceed the daily limit, AI features will become temporarily unavailable until the limit resets.

8. Calendar Sync

8.1 Two-Way Authorization

Together Hub offers optional two-way calendar synchronization with Google Calendar and Apple Calendar. To enable this feature, you must explicitly authorize the connection through the respective service's authentication flow. You can revoke this authorization at any time through your account settings within the App or through the third-party service's settings.

8.2 Your Responsibility

You are responsible for selecting which calendars to sync and for managing the content that is synchronized between services. You acknowledge that enabling calendar sync may cause events to be created, modified, or deleted in your connected calendar accounts based on changes made within Together Hub, and vice versa.

8.3 No Responsibility for Sync Errors

Together Hub is not responsible for any errors, data loss, or inconsistencies that may occur as a result of calendar synchronization, including but not limited to duplicate events, missing events, incorrect event details, or sync delays. We recommend periodically reviewing your synced calendars to ensure accuracy.

9. Acceptable Use

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. The following activities are strictly prohibited:

10.1 Our Intellectual Property

The Service and all of its original content (excluding User Content), features, and functionality are and shall remain the exclusive property of Together Hub and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of the United States and foreign countries. Our trademarks, service marks, logos, and trade names may not be used in connection with any product or service without our prior written consent.

10.2 Feedback

If you provide us with any feedback, suggestions, or recommendations regarding the Service ("Feedback"), you hereby assign to us all rights in the Feedback and agree that we have the right to use and fully exploit such Feedback in any manner we deem appropriate, without any obligation or compensation to you.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TOGETHER HUB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TOGETHER HUB DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TOGETHER HUB DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICE IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOGETHER HUB, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL TOGETHER HUB'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) FIFTY DOLLARS ($50.00) OR (B) THE TOTAL AMOUNT YOU HAVE PAID TO TOGETHER HUB IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Together Hub, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right; or (d) any claim that your User Content caused damage to a third party. This obligation shall survive the termination of these Terms and your use of the Service.

14. Termination

14.1 Termination by You

You may terminate your account at any time by deleting your account through the App's settings or by contacting us at support@togetherhub.tech. Upon termination, your right to use the Service will immediately cease. If you have an active paid subscription, please cancel it through the Apple App Store before deleting your account to avoid further charges.

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

14.3 Effect of Termination

Upon termination of your account, we will delete your personal data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide notice through the App, by sending you an email, or by other means, at least 30 days before the changes take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service and delete your account.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Georgia. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS, AND THAT YOU WILL NOT SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, A REPRESENTATIVE ACTION, A COLLECTIVE ACTION, A PRIVATE ATTORNEY-GENERAL ACTION, OR IN ANY PROCEEDING IN WHICH YOU ACT OR PROPOSE TO ACT IN A REPRESENTATIVE CAPACITY. YOU FURTHER AGREE THAT NO PROCEEDING WILL BE JOINED, CONSOLIDATED, OR COMBINED WITH ANOTHER PROCEEDING WITHOUT THE PRIOR WRITTEN CONSENT OF TOGETHER HUB AND ALL PARTIES TO ANY SUCH PROCEEDING.
